Spain approves major changes to immigration,

A new policy is being introduced following the deaths of several people after around 72,000 individuals attempted to enter Ceuta from Morocco.

What changes have been made to Spain’s visa policy?

Spain has begun preparing major changes to its immigration and asylum system.

According to international news agencies, the Spanish government has approved draft amendments to immigration legislation as well as a new draft law on asylum.

The main objective is to bring Spanish law into line with the European Union’s new Migration and Asylum Pact, speed up the processing of asylum applications, and make the screening of people arriving at the borders more organized.

Under the proposed new system, foreigners crossing the EU’s external borders who do not meet the entry requirements will undergo an initial screening or triage process.

This stage will include medical examinations, identification of vulnerable people or those in need of special protection, registration of identification information and biometric data, security checks, and referral to the appropriate procedure.

If a person’s application for international protection or asylum is rejected, the new system could inform them, at the time of the decision, of their obligation to leave the country.

Authorities said the changes would also help improve coordination between different government agencies.

New application procedure for asylum and migration

Through the new asylum law, Spain wants to make the application process faster and more efficient.

The proposed law seeks to clarify the process for examining applications and making decisions while maintaining legal protections for asylum seekers.

The draft also provides clearer definitions of refugees, refugee status, and subsidiary protection.

Issues such as gender, gender identity, disability, and serious risks faced by civilians during armed conflicts will also be more clearly incorporated into the legal framework.

According to authorities, guarantees concerning basic facilities, medical assistance, children’s education, permission to work, and care for people with special needs will also remain part of the system for asylum applicants.

Important information for people planning to go to Spain

It is important for Pakistanis and other foreigners who want to travel legally to Spain to understand that the new legislation does not mean that all legal routes for immigration to Spain are being closed.

Spain continues to offer different types of visas and residence permits for employment, education, family reunification, and other specific purposes. However, each permit has its own requirements, documentation, and application procedure.

Similarly, entering Spain illegally or violating the conditions of a visa can lead to legal difficulties. People planning to travel to Spain should check the latest requirements for the relevant visa and residence permit before travelling.

For example, according to Spain’s Ministry of Inclusion, Social Security and Migration, certain exceptional circumstances require applicants to meet specific conditions in order to obtain a residence permit.

One particular “social rooting” (arraigo) route requires at least two years of continuous presence in Spain, along with certain family or social-integration requirements and other conditions.

The Ceuta crisis increases pressure on the government

The decision comes at a time when Ceuta, a Spanish territory in North Africa, has faced an unprecedented migrant crisis in recent weeks.

On July 30, around 72,000 people reportedly attempted to enter Ceuta from Morocco, resulting in several deaths.

Although thousands of people subsequently returned, a large number are still in Ceuta. The crisis has further highlighted the pressure on Spain’s immigration system.

Following the sudden arrival of thousands of people, pressure increased on accommodation, food supplies, and other basic services in Ceuta. Thousands of people are still being forced to stay in temporary locations or in the open air.

The government has made temporary arrangements to deal with the crisis, while the situation of unaccompanied minors has also become an important issue.

In recent weeks, Spain has also decided to transfer some of the migrant minors in Ceuta to mainland Spain.

European Union’s new system also comes into effect

It would be incomplete to view Spain’s reforms solely as a response to the recent Ceuta crisis.

The European Union’s new migration and asylum system came into force on June 12, 2026. Under the new framework, member states are required to adopt new common rules concerning border screening, asylum applications, the allocation of responsibility, and the return system.

Has the law come into force immediately?

At present, the government has approved the draft legislation, but it still needs to go through the parliamentary process.

Therefore, people planning to travel to Spain should understand that not every proposed change is an immediately applicable law.

However, the EU’s new migration and asylum framework is already in force, and Spain is updating its laws and procedures accordingly.
