KP Police Issue New Guidelines for Handling Protests and Riots

Khyber Pakhtunkhwa Police have issued written operational instructions to deal with rioting and protest demonstrations.

According to the notification, District Police Officers (DPOs), Sub-Divisional Police Officers (SDPOs) and Station House Officers (SHOs) must personally attend protests in their jurisdictions, with adequate police personnel deployed to maintain order.

It directs the relevant officers to keep the Anti-riot squads ready for deployment, fully equipped with gas guns and tear gas shells.

Under the rules, DPOs may require protest organisers to obtain a licence under Section 84 of the KP Police Act 2017 if there is a likelihood of a breach of peace. Police authorities may stop processions violating permit conditions and order unlawful assemblies to disperse. Assemblies that violate applicable legal provisions may be declared unlawful.

It authorizes the Police officers to temporarily close or regulate streets and public places, including by erecting barriers, to prevent people or vehicles from entering areas for security reasons under Section 88 of the KP Police Act 2017.

The notification also states that where there is serious disorder, a breach of law or an imminent threat to life and property, the appropriate use of force may be ordered by an SDPO, SHO or the senior-most officer present after assessing the situation and declaring the assembly unlawful. The senior-most supervisory officer will determine the type and level of force required.

It further states that elements involved in rioting, vandalism and disrupting law and order will be dealt with strictly in accordance with the law. Damage to government installations, buildings and property will not be permitted under any circumstances during riots or protests.

 It warns that action in accordance with the law will be ensured against elements that disrupt public order, attack security forces or buildings, or endanger the lives and property of citizens.

The public is suggested to refrain from participating in any illegal gathering, violent activity or incitement; otherwise, the strictest legal action will be taken in accordance with the law.

They also are urged to remain peaceful, abide by the law and not be misled by disruptive elements.
Special arrangements will be made to protect police stations, government buildings, banks, petrol pumps, commercial centres and major highways.
