Following the special relief granted to Imran Khan, another prisoner has also approached the judiciary seeking similar relief for himself.
According to details, A prisoner at District Jail Lodhran has asked the judiciary to grant him the same special relief on medical ground which are given to Imran Khan.
Experts in the law and constitution fear that the precedent set can now be manipulated by majority of the prisoners for the privileges granted to Imran Khan by the apex court.
In the legal system of Pakistan, Judicial precedents are legal principles established through judicial decisions that serve as guidance or authority for deciding future cases involving similar legal issues without any discrimination. The lower courts to follow the legal principles established by superior courts. The ruling in Imran Khan’s case is feared to create chaos in the judicial system.
It is pertinent to note that Judicial precedents support the constitutional principle of equality before the law. If identical legal issues were decided differently without valid legal justification, public confidence in the justice system would decline.
This is also a noteworthy fact that since his imprisonment Imran Khan has been provided with every medical facility and he underwent 30 comprehensive medical checkups with physicians’ satisfaction about his health condition. His family members and friends have also been provided access to meet him. But contrary to the facts PTI leadership highlighted denial of all these facilities.
At present as per the directives of the Supreme court, the medical teams of PIMS and Shifa International examined him thoroughly and declared him fit with no serious health hazard.
After the recent medical checkup, the international media and observers have endorsed the government’s position regarding facilities inside the prison, and the provision of prisoners’ rights appears more transparent and plausible, rejecting the false narrative that the former prime minister is being kept in solitary confinement, is being mistreated, and is being deprived of basic medical facilities.
