Chief Justice race fueling resignations, says Speaker Punjab Assembly

Punjab Assembly Speaker Malik Ahmed Khan has said that there will be more resignations; this is a tug-of-war and division to become the Chief Justice.

Speaking at a ceremony in Lahore, Malik Muhammad Ahmed Khan said the country needs educated youth today. He added that educated women are the foundation of an educated society, and that the importance of women’s education is increasing with time.

He said the time has come to bury old and outdated ideas. He added that girls must be empowered to secure their own bright future. He stressed that government schools and colleges should offer the same facilities as private institutions. The Speaker Punjab Assembly questioned why 97% of the country’s children studying in government schools are being deprived.

He said the country is facing many challenges and added that a constitutional court is essential, stressing that parliament must be empowered and should have the authority to make appointments.

The Speaker of the Punjab Assembly said more resignations will follow, calling the situation a tug-of-war over the Chief Justice’s post. He added that court decisions had limited the powers of parliament and pushed it into a corner. He said parliament had even been afraid to speak about its own rights, and stressed that this must end now.

President Asif Ali Zardari has approved the resignations of Justice Mansoor Ali Shah and Justice Athar Minallah from the Supreme Court, the Presidency confirmed on Thursday. Both judges will formally step down tomorrow, marking a significant change in the apex court’s composition.

In another development authorities issued the notification for appointment of Judges for the Federal Constitutional Court.

Resignation letter of Justice Mansoor Ali Shah

Plans for Justice Mansoor Ali Shah to become Chief Justice of Pakistan have been altered following revisions to the 27th Constitutional Amendment. Although he is the senior-most judge in the country, the amendment now ensures that Chief Justice Yahya Afridi will remain in office until 2027, delaying any potential succession.

Justice Mansoor Ali Shah resigned, citing serious threats to the independence of the judiciary and the erosion of constitutional democracy. He said the recent constitutional amendment “has fragmented the Supreme Court” and placed the judiciary under the control of the government, undermining the spirit of constitutional democracy, leaving ordinary citizens without access to justice and rendering the weak powerless in the face of authority.
